ordering our web hosting service you agree to the following terms and
conditions.
Terms
and Conditions of Virtual Hosting Service
This is a legal and
binding agreement between you, the Customer, and us, 2GlobalMart.com. By using
or accessing 2GlobalMart.com website, it’s Services and certain Products that
are offered, as our Customer, you agree to all of the terms and conditions of
this agreement. If you do not agree to these terms, the Acceptable Use Policy or
any other Terms and Conditions posted on the 2GlobalMart.com web site, all
services will be discontinued, activation of the account will cease and your
account will be terminated.
END USER AGREEMENT
LICENSE GRANT. Subject to the provisions contained herein and payment of
applicable fees, 2GlobalMart.com hereby grants to you a non-exclusive,
nontransferable, license to use its web hosting service offered on
2GlobalMart.com web site ("Hosting service",) for your own use. Such Hosting
service is protected by the laws of the United States and the State of
California.
RESTRICTED USE AND
TERMS.
1) No adult and/or
gamble content is permitted; whether it is legal in you city, county or country.
No hyper links on your site permitted, such as those pointing to sites
containing adult content or promoting gambling, and those sites linking back to
your web pages that are hidden from your homepage.
2) Customer's site
cannot contain any illegal contents or link to sites containing illegal
contents, which include, but not limited to, pornography, obscenity, violations
of privacy, hacking, warez, irc programs, eggdrops, computer virus, and all
harassing and/or harmful materials or uses, as determined by us.
3) Customer is expressly
prohibited from sending unsolicited bulk mail messages ("junk mail" or "spam").
This includes, however, is not limited to, bulk-mailing of commercial
advertising, information announcements, and political tracts. Such material may
only be sent to those who have specifically requested it.
4) Customer is
prohibited to sponsor and/or promote any kind of spamming email during your
terms with 2GlobalMart.com, your hosting account. It is deemed a spam to
sponsor affiliates and/or others who send spamming emails using your hosting
account even though the spamming emails were not sent out from your website
directly.
5) Customer is
prohibited to use our mail server as an email marketing engine. Customer is
prohibited to send large quantity of emails via our mail server in a short
period of time within twenty four (24) hours. Sending thousands of emails a day
from your site itself is a spam to our mail server.
6) Customer is not
allowed to install his or her own chat room scripts which tend to be a source of
strain or destruction on our system resources. We cannot allow it as an account
option unless prior written authorization is submitted by our technical support
team .
7) Any attempt to
undermine or cause harm to a server, or customer of 2Globalmart.com is strictly
prohibited. Should this behavior become knowledge to 2Globalmart.com it is
immediate cause for suspension and/or termination.
8) The web space and
mail server are for the usage of 2Globalmat.com customers use only; customer is
expressly prohibited to install special scripts in order to resell web space and
email accounts to any third party or offer free web hosting and/or free email
services from Customer website. This does not include offering a third party's
free email and/or hosting service such as everyone.net or bigbox, etc. via
Customer website.
PAYMENT, MONEY BACK
GUARANTEE AND REFUND
1) The web hosting fee
is paid at beginning of each billing cycle of Customer hosting plan. Each
customer is responsible to update & maintain current credit card information;
such as credit card number, expiration day, and billing address for accurate
payment processing. Customer agrees to pay $10.00 late payment when account is
late.
2) Renewal and
automatic payment are generated for consistent usage. All accounts are
automatically renewed as per billing cycle. In the event of cancellation or
termination; it is the responsibility of the customer to notify 2Globalmart.com
within forty eight (48) hours of beginning cycle.
3) There are some fees
are charged based on Customer's actual usage of our server resources, and the
prices are listed in Customer billing center within control panel. For
instance, extra bandwidth usage currently costs $3.00 per extra GB data transfer
per month. In case Customer's site uses more bandwidth than what it is given
by Customer hosting plan in one month, Customer will be charged for it.
4) We offer fifteen (15)
day money back guarantees and risk free service to your Customers. Customers may
cancel account at any time within the first fifteen (15) days after Customer's
has signed up by applying Money Back in Customer online billing center or
sending a cancellation email to
billing at 2globalmart.com. We will promptly refund the Customer the
hosting payment upon receiving Customer's cancellation in the fifteen (15) days
period; however, under no circumstances will a refund be issued beyond this
mentioned period.
5) It is Customer's
responsibility to unsubscribe our hosting service via PayPal any time when
Customer decides to stop using our hosting service if Customer paid by Paypal to
avoid from sending further hosting fees to us. The PayPal refund will be sent
out only after Customer unsubscribe the hosting service via PayPal and after
Customer applies the money back with the first fifteen (15) days period.
6) Free domain
registration means that domain registration fee $14.95 per domain per year will
be paid by us and thus is included in Customer's hosting cost if Customer orders
Plan 1 through Plan 3 with annual payment. Should Customer decide to cancel the
hosting account within the fifteen (15) days after Customer has signed, we'll
refund the balance of Customer's annual payment deducting domain registration
fee $14.95 per domain from it since domain registration fee is non-refundable by
registrar.
7) To avoid recurring
charges to Customer’s credit card or PayPal account, it is the Customer’s
responsibility to apply cancellation at least 48 hours before next billing cycle
begins.
LIMITED WARRANTY
THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER LEGAL
RIGHTS THAT VARY FROM STATE TO STATE OR BY JURISDICTION.
LIMITATION OF LIABILITY. UNDER NO CIRCUMSTANCES AND UNDER NO LEGAL THEORY,
CONTRACT, OR OTHERWISE, SHALL 2GLOBALMART.COM OR ITS SUPPLIERS OR RESELLERS
BE LIABLE TO YOU, THE CUSTOMER OR ANY OTHER PERSON FOR ANY INDIRECT, SPECIAL,
INCIDENTAL, OR CONSEQUENTIAL DAMAGES OF ANY CHARACTER INCLUDING, WITHOUT
LIMITATION, DAMAGES FOR LOSS OF GOODWILL, WORK STOPPAGE, COMPUTER FAILURE OR
MALFUNCTION, SERVERS GOING OFF-LINE OR BEING UNAVAILABLE FOR ANY REASON
WHATSOEVER, OR ANY AND ALL OTHER COMMERCIAL DAMAGES OR LOSSES, OR FOR ANY
DAMAGES RESULTING FROM THE CORRUPTION OR DELETION OF ANY WEB SITE FROM ONE OF
2GLOBAFLMART INTERNATIONAL SERVERS, IN EXCESS OF 2GLOBALMART.COM'S LIST PRICE
FOR A LICENSE TO THE WEB HOSTING SERVICE AND DOCUMENTATION, EVEN IF
2GLOBALMART.COM SHALL HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGES, OR
FOR ANY CLAIM BY ANY OTHER PARTY. THIS LIMITATION OF LIABILITY SHALL NOT APPLY
TO LIABILITY FOR DEATH OR PERSONAL INJURY TO THE EXTENT APPLICABLE LAW PROHIBITS
SUCH LIMITATION. FURTHERMORE, SOME STATES DO NOT ALLOW THE EXCLUSION
OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS LIMITATION AND
EXCLUSION MAY NOT APPLY TO YOU.
All damages shall be limited to the immediate termination of service.
We cannot be held liable
for system downtime, crashes, or data loss. We cannot be held liable for any
predicted estimate of profits in which a client would have gained if their site
was functioning. Moreover, 2Globaflmart.com holds no responsibility for the use
of our clients accounts.
Customer agrees to
release, indemnify, and hold us and our contractors, agents, employees,
officers, and affiliates harmless from all liabilities, claims and expenses,
including attorney’s fees, resulting from your publications or use of illegal,
abusive or unethical materials.
TERMINATION
This Agreement is
effective until terminated. It is at the decision and discretion of
2GlobalMart.com if it shall terminate this Agreement immediately if Customer
violates these terms and conditions of Hosting Service, and the Customer hosting
account will be deactivated without refund of payment with or without a notice
depending on the specific situation.
We reserve the right to
refuse, cancel, or suspend service at our sole discretion.
2Globalmart.com retains
the right to add, delete or modify or to make any changes of this Terms and
Conditions without notice.
